Imran Khan’s lawyer objects to new bench in Article 63-A review hearing
ISLAMABAD, Oct 01: During the Supreme Court's hearing of the Article 63-A review case, former Prime Minister Imran Khan’s lawyer, Barrister Ali Zafar, raised objections to the newly formed bench. The case is being heard by a five-member larger bench headed by Chief Justice Qazi Faez Isa. Other members include Justice Aminuddin, Justice Jamal Mandokhail, Justice Naeem Akhtar Afghan, and Justice Mazhar Alam Mian Khel.
At the start of the hearing, Supreme Court Bar President Shehzad Shaukat and PTI's lawyer Ali Zafar appeared before the bench. Ali Zafar objected to the composition of the bench, but Chief Justice Qazi Faez Isa interrupted him, advising him to refrain from disrupting the proceedings. Despite being asked to wait for his turn, Zafar repeatedly insisted on being allowed to voice his concerns.
Chief Justice Isa firmly responded, “Do you not understand what I am saying? We respect you, so please show some courtesy. This is not how democracy works—speak in your turn. We will hear you, but first, let Shehzad Shaukat speak. Isn’t he your president?”
The hearing took place after the Supreme Court’s Practice and Procedure Committee formed a new bench, including Justice Naeem Akhtar Afghan, following an early morning meeting. Justice Mansoor Ali Shah had been proposed for the bench but was replaced by Justice Afghan as Shah did not attend the committee meeting.
It is noteworthy that Justice Muneeb Akhtar had previously excused himself from the Article 63-A review case, raising concerns over the bench's composition and Chief Justice Isa's inclusion. Justice Muneeb had also written to the Supreme Court Registrar, questioning the participation of ad-hoc Judge Justice Mazhar Alam, calling it contrary to Article 182.
