Islamabad Court Reserves Verdict in "Illegal Marriage" Case Against Former Chairman PTI

ISLAMABAD, The District and Sessions Court in Islamabad has reserved its decision on the admissibility of an "illegal marriage" case against the former Chairman of the Pakistan Tehreek-e-Insaf (PTI) and his wife Bushra Bibi.
The hearing took place on Monday, December 11th, 2023, before Civil Judge Qudratullah. Petitioner Khawar Manika, Bushra Bibi's ex-husband, appeared in person and his lawyer, Rizwan Abbasi, presented arguments on the admissibility of the case.
Abbasi argued that the law allows for prosecution based on the testimony of two witnesses, including one who witnessed the alleged pre-marital relationship. He cited Section 203 C of the Pakistan Penal Code as applicable in this case.
The judge, however, pointed out that the law requires two independent witnesses in addition to the complainant. While granting Abbasi additional time for arguments, he emphasized the importance of fulfilling legal requirements.
Concerns were raised regarding the lack of medical evidence, as Abbasi claimed that no such examination is necessary in adultery cases. He further stated that Khawar Manika became a witness after hearing about the alleged act from a servant.
The court expressed reservations about Khawar Manika's dual role as complainant and witness, questioning the validity of his testimony. Abbasi argued that the marriage ceremony itself serves as evidence, along with the eyewitness and the individual who heard about the act.
After completing arguments, the District and Sessions Court reserved its verdict on the admissibility of the case. The final decision will determine whether the case will proceed to trial.
