Islamabad High Court Dismisses Petition Against Possible Military Trial of Imran Khan

ISLAMABAD, Sep 24: The Islamabad High Court has dismissed a petition seeking to prevent the possible military detention and trial of Pakistan Tehreek-e-Insaf (PTI) leader Imran Khan, following assurances from the government that no such decision has been made yet.

During the hearing, Justice Mian Gul Hassan Aurangzeb sought a response from the federal government. Additional Attorney General Manawar Iqbal Dogal informed the court that there has been no decision regarding Imran Khan's military trial to date. He stated that if a decision is made, it will follow proper legal procedures under Section 549 of the Criminal Procedure Code (CrPC), which requires presenting the case before a civil magistrate.

On this assurance, the court dismissed the petition. Justice Aurangzeb remarked that if a military trial is initiated, Imran Khan will be duly notified. He emphasized that legal procedures must be followed, noting that even in cases under the National Accountability Bureau (NAB), which has been criticized as draconian, a process is in place.

The court had previously asked for clarity on the procedures for military detention and trial. The Ministry of Defence’s representative explained that civilians could be tried under the Army Act in certain cases. However, the court requested a clear stance from the government on whether Imran Khan would face a military trial.

The Islamabad High Court awaits a detailed response from the government on this matter.
