Nawaz Sharif's Nomination Papers Cleared in Mansehra After PTI Challenge Rejected
Peshawar, former Prime Minister Nawaz Sharif's nomination papers have been accepted from the NA-15 Mansehra constituency, following the dismissal of objections raised by the opposition Pakistan Tehreek-e-Insaf (PTI) party.
Lawyers for both sides argued their cases before Returning Officer Hajra Sami. The decision comes after weeks of legal wrangling surrounding Sharif's eligibility to contest the polls.
Azam Swati, a prominent PTI leader, had filed objections against Sharif's nomination papers, claiming that he remains disqualified for life from holding public office under Article 62(1)(f) of the Constitution. Swati argued that a Supreme Court decision disqualifying Sharif based on corruption charges remains valid and binds lower courts, including the returning officer.
However, Sharif's lawyers countered the argument, asserting that the returning officer has the authority to determine his eligibility based on existing law and evidence. They argued that the Supreme Court did not impose a lifetime disqualification, and subsequent developments, including amendments to the Election Act, cleared the way for his participation in the upcoming elections.
After hearing both sides, Returning Officer Sami upheld Sharif's candidacy. This decision clears the path for him to campaign for the NA-15 seat in the upcoming polls.
The verdict is likely to be appealed by the PTI, setting the stage for further legal battles over Sharif's eligibility. The case may potentially reach higher courts before a final determination on his candidacy is made.
